1. Agreement to These Terms

1.1 These Terms & Conditions ("Terms") form a binding agreement between you ("you," "your," or "User") and the Company governing your access to and use of the Service.

1.2 By accessing, browsing, or using the Service in any way — including clicking any outbound link to a third-party retailer — you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Service.

1.3 We may modify these Terms as set out in Section 18. Your continued use after changes take effect constitutes acceptance of the revised Terms.

2. Definitions

"Service" — the us-gundeals.com website and all related content, features, search tools, price listings, and functionality we provide.

"Retailer" or "Third-Party Retailer" — any independent third-party merchant, seller, dealer, or website to which the Service links or refers, and which is solely responsible for any sale, transaction, fulfillment, compliance, and shipping.

"Listings" — product, price, specification, availability, and related information displayed on the Service that is sourced from or about Third-Party Retailers and manufacturers.

"Content" — all text, data, graphics, images, logos, compilations, and other materials available through the Service.

3. What the Service Is — and What It Is Not (Information Service Only)

3.1 The Service is an informational price-comparison and discovery tool only. We aggregate publicly available and licensed product, price, and specification information and present it to help you compare offers. When you choose to act on a Listing, the Service directs you, via an outbound link, to the website of an independent Third-Party Retailer.

3.2 We do not sell, offer to sell, ship, transfer, broker, facilitate the transfer of, or take possession of any firearm, ammunition, firearm part, accessory, or any other product. We do not process orders, collect payment for products, hold inventory, or participate in any transaction between you and any Retailer.

3.3 We hold no United States Federal Firearms License (FFL) and are not a firearms dealer, manufacturer, importer, or transferor. We are not "engaged in the business" of dealing in firearms or ammunition within the meaning of applicable US federal law, and no transaction, background check, age verification, recordkeeping, or transfer is conducted by us or through the Service.

3.4 All sales and transactions occur solely between you and the Third-Party Retailer, on that Retailer's website, subject to that Retailer's own terms, policies, prices, and compliance procedures. The Retailer — not the Company — is solely responsible for verifying your identity, age, and eligibility; conducting any required background checks; complying with all applicable laws; collecting taxes; and fulfilling, shipping, and servicing any order.

3.5 We do not vet, endorse, recommend, guarantee, or assume responsibility for any Third-Party Retailer, or for any Retailer's products, prices, conduct, solvency, fulfillment, customer service, legal compliance, or business practices. The presence of a Retailer or product on the Service is not an endorsement, certification, or warranty of any kind. Any "best price," "trusted," "featured," or similar designation reflects our internal, non-binding criteria only and is not a guarantee.

3.6 Your dealings with any Retailer are solely between you and that Retailer. Any dispute regarding a product, price, order, payment, delivery, defect, or refund is between you and the Retailer (see Section 16).

4. Eligibility and Your Legal-Compliance Responsibilities

4.1 Age. You represent and warrant that you are at least 18 years of age, and at least 21 years of age where the products you view or the jurisdiction you are in require it. The Service is intended solely for adults legally permitted to view, purchase, and possess the products displayed.

4.2 Lawful eligibility. You represent and warrant that you are not prohibited by any applicable federal, state, or local law from purchasing, receiving, or possessing firearms, ammunition, or any product displayed on the Service, and that your use of the Service and any purchase you make is lawful in your jurisdiction.

4.3 Sole responsibility for compliance. You are solely responsible for knowing and complying with all federal, state, county, and municipal laws and regulations that apply to you, including but not limited to firearm and ammunition purchase, possession, transport, registration, and transfer laws; background-check requirements; ammunition purchase and shipping restrictions; magazine-capacity limits; "assault weapon," feature, and configuration restrictions; waiting periods; and import/export controls. These laws vary significantly by jurisdiction and change frequently.

4.4 No representation of legality. We make no representation or warranty that any product displayed on the Service is legal to purchase, possess, ship to, or use in your state or locality. A product appearing on the Service does not mean it is lawful for you. It is your responsibility — and the Retailer's — to confirm legality before any purchase. Nothing on the Service constitutes legal advice.

4.5 No circumvention. You agree not to use the Service to attempt to acquire, or to assist anyone in acquiring, any product in violation of any law, including any attempt to evade age, eligibility, background-check, or jurisdictional restrictions.

5. Pricing, Availability, and Information Accuracy

5.1 Information is sourced from third parties. Prices, specifications, availability, images, and other Listing information are supplied by or compiled about Third-Party Retailers and manufacturers. We do not set, control, or guarantee any price or any product's availability.

5.2 Information may be inaccurate, incomplete, or out of date. Prices and availability change frequently, and our price data is refreshed periodically rather than in real time, so information may be out of date when you view it. Any "last updated" indication shows when our data was last refreshed and does not guarantee current accuracy. You must verify the current price, availability, specifications, shipping cost, fees, taxes, and all terms directly on the Retailer's website before completing any purchase. The price and terms shown at the Retailer's checkout govern.

5.3 The Company's liability in connection with any reliance on Listing information is governed exclusively by Sections 14 and 15.

5.4 Comparative descriptions. Where the Service describes an offer using comparative or superlative language (e.g., "lowest price," "best deal"), such descriptions are based on the limited data available to us at the time of the last refresh, may not reflect all offers or all costs (including shipping, fees, and taxes), and are not a guarantee that no better price exists.

6. Affiliate Relationships and Disclosure

6.1 We may be compensated for outbound clicks and referrals. We participate in, or intend to participate in, affiliate, cost-per-click (CPC), and similar programs. When you click certain links and/or make a purchase from a Retailer, we may receive compensation at no additional cost to you. You should assume any outbound link may be a compensated link.

6.2 Compensation does not determine rankings. Offers are sorted by lowest total price (including shipping where available) by default. The order in which offers are displayed is determined by price, not by compensation, and affiliate relationships do not influence ranking or placement. No placement on the Service is paid.

6.3 No additional cost. Affiliate compensation never increases the price you pay at the Retailer.

7. Intellectual Property

7.1 Our property. The Service, including its design, compilation, organization, original text, graphics, and the selection and arrangement of Content, is owned by the Company or its licensors and is protected by intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, scrape, republish, or create derivative works from the Service or its compiled data.

7.2 Third-party marks. Product names, brand names, retailer names, trademarks, service marks, and logos displayed on the Service are the property of their respective owners. We use such marks only nominatively, to identify and describe the products and Retailers being compared. We are not affiliated with, authorized by, sponsored by, or endorsed by any Retailer or manufacturer, and no such affiliation or endorsement is implied.

7.3 Product images. Product images, where displayed, are sourced from manufacturer or Retailer feeds or other licensed or publicly available sources and remain the property of their respective owners. If you are a rights holder and believe content infringes your rights, see our DMCA Policy.

8. Copyright Complaints (DMCA Policy)

8.1 We respect intellectual-property rights and respond to notices of alleged copyright infringement under the US Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. See our separate DMCA Policy for full details.

8.2 If you believe content on the Service infringes your copyright, send a written notice to our Designated Agent containing all elements required by 17 U.S.C. § 512(c)(3).

8.3 We may remove or disable access to allegedly infringing material and may terminate access for repeat infringers.

9. Acceptable Use and Prohibited Conduct

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• scrape, crawl, harvest, index, or use any automated means to access, copy, or collect Content or data from the Service, except as we expressly authorize in writing;
• attempt to acquire, or help any person acquire, any product in violation of any law or in circumvention of any age, eligibility, background-check, or jurisdictional requirement;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its systems;
• reverse engineer, decompile, or attempt to derive the source code or underlying data structures of the Service;
• remove, obscure, or alter any proprietary notice; or
• use the Service to transmit malware or engage in any fraudulent or harmful activity.

10. Third-Party Websites and Links

10.1 The Service contains links to Third-Party Retailers and other third-party websites that we do not own or control. We provide these links for convenience only.

10.2 We are not responsible for, and make no warranty regarding, any third-party website, including its content, products, prices, privacy practices, security, or legal compliance. Your access to and use of any third-party website is at your own risk and subject to that website's own terms and policies.

11. Assumption of Risk Regarding Firearms and Ammunition

11.1 You acknowledge that firearms, ammunition, and related products are inherently dangerous and are subject to extensive regulation. You assume all risk arising from your viewing, purchase, receipt, possession, handling, storage, transport, and use of any product, and from any transaction you enter into with any Retailer.

11.2 Nothing on the Service is safety, training, legal, or technical advice. You are responsible for obtaining proper training and for the safe and lawful handling, storage, and use of any product.

12. No Professional Advice

The Service provides general informational content only and does not constitute legal, financial, safety, or professional advice. You should consult a qualified professional and confirm all legal requirements applicable to you before acting on any information found on the Service.

13. Privacy and Cookies

13.1 Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and disclose personal data and how we obtain cookie consent.

13.2 Because the Company is established in the European Union, our processing of personal data is subject to the EU General Data Protection Regulation (GDPR) and applicable German and ePrivacy rules, in addition to any applicable US state privacy laws. Where required, non-essential cookies and similar technologies are used only with your prior consent, which you may withdraw at any time. Nothing in these Terms waives any non-waivable data-protection right you may have.

14. Disclaimer of Warranties

14.1 THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by applicable law, the Company disclaims all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty regarding the accuracy, completeness, currency, reliability, or availability of any Listing, price, or Content.

14.2 We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any price or product information is accurate or current.

14.3 Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, some of the above exclusions may not apply to you, and you may have additional rights.

15. Limitation of Liability

15.1 To the maximum extent permitted by applicable law, the Company and its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service, any Listing or Content, any transaction with or conduct of any Retailer, or any product, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

15.2 In no event will the Company's total aggregate liability arising out of or relating to the Service or these Terms exceed USD 100. Because the Service is provided free of charge to Users, this cap is intentionally minimal.

15.3 We are not liable for the acts, omissions, products, pricing, fulfillment, or legal compliance of any Third-Party Retailer, or for any dispute between you and any Retailer.

15.4 Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law, and nothing in these Terms limits liability that cannot be limited by law (including, where applicable, liability for death or personal injury caused by negligence, fraud, or willful misconduct).

16. Release and Indemnification

16.1 Release. Your dealings and any disputes with any Retailer are solely between you and that Retailer. To the maximum extent permitted by law, you release the Company from any claims, demands, or damages arising out of such dealings or disputes.

16.2 Indemnification. You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and licensors from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms or any law or regulation; (c) your purchase, possession, transport, or use of any product; (d) any transaction or dispute between you and any Retailer; or (e) your violation of any third-party right.

16.3 We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.

17. Governing Law and Dispute Resolution

17.1 Governing law. These Terms and any dispute arising from or relating to them are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law of your place of residence applies and cannot be waived.

17.2 Informal resolution first. Before filing any claim, you agree to contact us at info@us-gundeals.com and attempt to resolve the dispute informally for at least 30 days.

17.3 Binding arbitration. Any dispute not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court.

17.4 Class-action waiver. To the maximum extent permitted by law, disputes will be conducted only on an individual basis and not as a class, collective, or representative action.

17.5 EU consumers. If you are a consumer resident in the European Union or EEA, nothing in this Section deprives you of the protection of mandatory provisions of the law of your country of residence, including your right to bring proceedings in your local courts; the arbitration agreement and class-action waiver in 17.3–17.4 do not apply to you to the extent they conflict with those mandatory protections.

18. Changes to the Service and to These Terms

18.1 We may modify, suspend, or discontinue the Service or any part of it at any time, subject to Section 15.

18.2 We may revise these Terms. We will update the "Last Updated" date and, for material changes, provide reasonable notice where required. Your continued use after the changes take effect constitutes acceptance.

19. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Sections that by their nature should survive termination (including Sections 3, 4, 5.3, 7, 11, 14, 15, 16, and 17) will survive.

20. General Provisions

20.1 Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Company regarding the Service and supersede any prior agreements.

20.2 Severability. If any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be enforced to the maximum extent permitted.

20.3 No waiver. Our failure to enforce any provision is not a waiver of it.

20.4 Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

20.5 No third-party beneficiaries. These Terms create no third-party beneficiary rights, except that the Company's officers, directors, employees, agents, and licensors are intended beneficiaries of Sections 14, 15, and 16.

20.6 Language. These Terms are drafted in English, which governs their interpretation, except where mandatory law requires otherwise.
